Acceptance of the Terms#

By using any application or digital service provided by Enzar Digital, or by visiting our website, you acknowledge that you have read, understood, and agreed to be bound by these Terms & Conditions. If you do not agree to any provision of these Terms, please stop using our services.

Acceptable use#

You agree to use our services exclusively in a lawful and legitimate manner, in full compliance with the following:

• Complying with all applicable local and international laws and regulations.
• Not using the service for any fraudulent, misleading, or harmful purpose.
• Not attempting to gain unauthorised access to our systems or to the data of other users.
• Not publishing any offensive or defamatory content, or content that infringes the intellectual property rights of others.
• Not reselling the service or exploiting it for the benefit of third parties without obtaining our prior written permission.

Prohibited uses#

It is expressly prohibited to use our services or digital products for any of the following purposes: fraud, deception, or circumvention of any kind; harassment or defamation of others; distributing malicious software or carrying out any hacking attempts or cyberattacks; or infringing the intellectual property rights of the Company or any other party. It is also prohibited to use our services in any unlawful activity that conflicts with the regulations and legislation in force in the Kingdom of Saudi Arabia or in any other jurisdiction.

Intellectual property rights#

All content, designs, source code, trademarks, product names, and all materials associated with Enzar Digital are the exclusive property of the Company or its licensors. No party may copy, modify, distribute, or reuse these materials in any form without obtaining the express written permission of the Company.

With respect to products and technical solutions developed on a custom basis for clients, intellectual property rights are explicitly defined within the service contract signed with each individual client, and that contract is the decisive reference document in this regard.

Termination of service#

We reserve the right to suspend or terminate your access to the service at any time, in the event that your violation of any of these Terms is established, or upon suspicion of fraudulent activity or misuse of the service. In non-urgent cases, we will endeavour to notify you in advance before taking any action.

Disclaimer and limitation of liability#

Our services are provided "as is" to the extent permitted by law. Enzar Digital shall not be liable for any indirect, incidental, or consequential damages arising from your use of, or inability to use, the service, including loss of data, profits, or business opportunities. In all cases, our liability is limited to the amount you paid for the service during the twelve (12) months preceding the occurrence of the damage.

Governing law and dispute resolution#

These Terms & Conditions are governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia. In the event of any dispute regarding the interpretation or application of these Terms, the parties shall first endeavour to settle it amicably; failing that, the Saudi judiciary shall have jurisdiction to consider it.

Changes to the Terms#

We reserve the right to amend these Terms & Conditions at any time. You will be notified of any material changes via your registered email or through a prominent notice in the application, at least 14 days before the effective date of the changes. Your continued use of the service after the effective date of the changes constitutes implied acceptance of them.
